Acceptance of Terms

DeTnk.(hereafter ‘DeTnk.’ or ‘DeTnk.com’) is a think tank, online gallery and marketplace for design. By using the DeTnk.com website you are fully agreeing to the following Terms and Conditions contained within this notice. You agree that at any time DeTnk. and any associated entities may change the service. You further agree that DeTnk. shall not be liable to you or any third party for any amendment, suspension, or discontinuation of the service or interruption in access to the DeTnk.com website.


Privacy Policy

We are committed to responsible data management and subscribe to the principals of the data protection legislation in the UK. We are committed to maintaining the privacy of our users and maintaining the security of any personal information received from you.

If a service on our website requires you to open an account you will be required to complete the registration process by providing certain information and registering a username and password for use with that service. The information provided by you will not be available for sale or use by third parties. The information is used solely for our own records and to notify you of changes or updates to the website/services, except in the event of the arrangement of shipment and delivery of a product purchased through DeTnk.com. When purchasing an item through DeTnk.com, you will be asked to provide a delivery address for the item, whereby you agree that this address may be given to our manufacturers and shipping companies to organize delivery for the specified purchase only. This information will not be kept on record for use by these parties beyond the designated delivery.
Upon registering for a service you agree that you will be responsible for what occurs under your user id. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security. In no event will DeTnk. be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password.


Acceptable Use

You agree that you will be solely responsible for all information that you post or upload. You warrant and represent that the content does not and will not (a) infringe on any copyright or any other personal or property rights of any person or be in breach of any statute or regulation, (b) entitle any person to claim any payment from, and that (c) you insure that any persons appearing in the material have given their consents to enable us to make and promote, and use the material in all manner and in all media throughout the world for the full period of the copyright.

In using the website/services you agree not to post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful.

You must not misuse our website by knowingly introducing viruses or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via detrimental technological material. By breeching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website will cease immediately.

DeTnk. will not be liable in any way for any loss or damage of any kind resulting from the use of any content transmitted via the services in the form of technologically harmful material that may infect your computer equipment due to your use of our website, and you agree to bear all risks associated with the use of any content, including any reliance on the accuracy or completeness of such content.

Disclaimers and Limitation of Liability

Use of the DeTnk.com website, and its services, or any affiliated entities is at your own risk. To the extent permitted by law, DeTnk.com and any of its affiliated entities will not be liable for any indirect or consequential loss or damage whatsoever arising out of or in connection with the use of the website/services. Any information from the website/services is accessed and downloaded at your own risk and you will be solely responsible for any damages to your computer system or loss or corruption of data that results.

DeTnk.com and any of its affiliated entities reserve the right to refuse use of the services as well as reserve the right to refuse or remove images or text posted on the website.

The Terms and Conditions may be updated or amended as necessary at the discretion of DeTnk. without notice to you. It is therefore your responsibility to check this page regularly for any such changes.

Products

We guarantee that all products available for purchase on DeTnk.com are genuine productions of the manufacturers they are advertised from.

All products available for purchase in the DeTnk Collecting Design Market are described on the specific product page on the website as accurately as possible via photography and informational points. We cannot guarantee that colours and details in the website image are accurate representations of the product, and sizes might in some cases be approximate.

If samples of fabric or finishes are required or request by you, DeTnk is not responsible for shipment costs and these expenses will be added to your order and charged to you. These charges will be confirmed to you prior to shipment.

Payment

All orders on DeTnk are conducted by a trained member of our DeTnk team via email, to provide the most personalised service possible to our clients. Your debit or credit card will be charged for the whole amount of the purchase on the commencement of the order, with the balance for shipment due prior to delivery, which will be issued in a separate invoice.

All orders are to be paid directly using a credit or debit card either over the phone to a member of the DeTnk team or through a PayPal account. We accept all major credit cards.

Alternatively, for large orders, payment can be made via bank transfer. To use this service, one must make a request at the time of placing an order.

We do not store credit or debit card details after an order has been processed. This information will be destroyed once the transaction is completed.

Shipment/Delivery

Prices listed online do not include VAT or cost of delivery. Delivery prices vary depending on an order’s size and delivery location. Additional charges may be assessed to the order for remote or difficult access locations.

Delivery lead time varies depending on the product. Items may be in stock, back ordered, or made to order. Therefore the average delivery time for an item that is in stock is 2 to 5 weeks and 10-16 weeks for items made to order from the date when payment has been received. The estimated delivery lead time for your order will be issued in an email sent confirming the order.

Before ordering from us, it is your responsibility to determine your full ability to receive the products, including ensuring that the product(s) ordered can pass freely through any passageways/doorways/stairways into the desired room of placement. We do not accept responsibility for any complications during delivery due to structural layout. We also do not accept responsibility for missed deliveries, or complications arising from an incorrect delivery address, or phone number. All additional charges for these delivery complications, or for rescheduling delivery will be added to your order and charged to you.

Depending on the items weight, size and quantity, different carriers and services might be used for your order delivery. In all cases, you will be advised of the estimate delivery times in advance.

Property

All items ordered will remain under the ownership of DeTnk until payment for all the goods, shipment, delivery, and any additional expenses has been received. DeTnk has the right to retain/reclaim ownership on any items with outstanding invoices.

The return of any items recalled due to outstanding payment in not the responsibility of DeTnk and monetary costs will be at the returner’s expense.

Return Policy

The return or exchange of items that are found damaged or defected upon arrival will be coordinated by the DeTnk team if reported within a 24 hour period from the time the items are received. These reports should be sent to info@detnk.com with images and other relevant information that may act as proof of damage. The terms of the return or exchange are dependent on the terms of the specific manufacturer.

At the time of placing your order you will be given the option of purchasing insurance for the shipment of your order. If you decline to purchase insurance, you become responsible for any damages incurred during shipment or delivery. DeTnk will not be liable for these damages and all monetary charges will be your responsibility.

With the exception of defects, all sales on DeTnk are final with no exchanges or refunds granted. If you are unhappy with your purchase and decide you do not wish to keep the item(s), we will help you to resell your purchase on consignment through the DeTnk Collecting Design Market with no guarantee of sale. The consignment fee for resale items will be 28%.

Collectors Club

DeTnk. offers the special collectors price of a 10% discount on designated items to registered users in possession of a Collectors Club Membership Card. Members must present this card at the time of purchase via email to receive the discount. Members of the trade community with registered VAT numbers, and established collectors may apply for a Collectors Club: VIP Card, which will give them a VIP price of 20% off all designated items. DeTnk. reserves the right to refuse or remove membership to this service at any time, without indemnity to those refused,  and without prior notification.

A membership is valid for the current calendar year and renewed automatically on a yearly basis unless cancelled by either party. Membership can be cancelled via email to info@detnk.com.

DeTnk retains the right to change the terms and offers of its membership services at any time, without prior notification. You are responsible for checking this section for updates to the site’s terms and conditions.


Governing Law

These Terms and Conditions shall be governed by and construed on accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
